Bourgeois died on Sept. 27, 2024, a few days after what police described as a “serious assault” in the downtown bar district.Totten was 18 at the time of the assault and the only adult accused in Bourgeois’s death. He was originally charged with manslaughter, but last month pleaded guilty to the lesser charge of summary assault.At a sentencing hearing in Fredericton on Tuesday, the court heard that Totten kicked Bourgeois’s chest and shoulder area a single time, but that no marks, bruising or injury were observed in that area. All other evidence is covered by a publication ban — including details of the agreed statement of facts, reasons behind the sentencing, as well as victim impact statements from Bourgeois’s sister, Lisa Bourgeois, and mother, Beverly Bourgeois.Justice Lyne Raymond accepted a request from Crown prosecutor Patricia Gillett for the ban, in order to protect the other case involving three youths who are being tried separately, and any potential jury pool if one is needed.André Bourgeois of Grand-Digue died following a serious assault in Fredericton’s bar district. Their identities are protected by the Youth Criminal Justice Act and they are not in custody. Twenty days have been set aside for that trial, which is set to begin on Sept. 28, 2026. Raymond followed a joint recommendation from Gillett and defence lawyer Brian Munro for Totten’s sentencing, which included a 12-month suspended sentence, 12 months of supervised probation and 100 hours of community service.Totten is also ordered to have no contact with the victim’s family, follow any recommended counselling and pay a $100 victim fine surcharge.
